Dear bathing guests!
By booking a room, you are entering into a bathing contract with the Stäfeli and thereby legally acknowledging the following bathing regulations as part of the contract.
1. Obligations of the bathing facility
1.1. Granting of the use of the facilities, assumption of risk by the guests
(1) At Stäfeli, we allow guests to use the facilities of the bathing establishment at their own risk, in accordance with the regulations of these bathing rules.
(2) It is not possible for either the Stäfeli or its staff to prevent bathing accidents in general. In particular, guests themselves bear the risks associated with participating in sports activities on the bathing premises.
(3) The same applies to injuries and other interferences with the
Privacy of the bather by other guests or other third parties not belonging to the staff of the bathing facility.
(4) The Stäfeli assumes only the obligations listed below towards its guests.
1.2. Opening hours and access restrictions
(1) We at Stäfeli are obliged to allow visits during the opening hours announced by notice or by the supervisory staff.
(2) We at Stäfeli reserve the right to refuse entry to persons whose admission to the bathing area appears questionable, without giving reasons.
(3) Animals are not permitted. Exceptions are made for police and rescue service dogs, as well as guide dogs, assistance dogs and service dogs, insofar as this is necessary for the performance of their duties.
1.3. Condition and operation of the systems
(1) The bathing facility is responsible for ensuring that the facilities are constructed, operated, and maintained in accordance with regulations. In particular, the bathing facility must comply with all applicable hygiene and safety regulations. The bathing facility has no further obligations.
(2) As soon as the bathing facility becomes aware of a malfunction, defect or damage to a facility which no longer guarantees safe operation, the bathing facility shall immediately prohibit the use of the malfunctioning facility or restrict its use appropriately.
(3) The bather is responsible for complying with instructions given by the staff.
1.4. Monitoring compliance with the bathing regulations
At Stäfeli, we, with the assistance of our staff, monitor compliance with the bathing regulations by guests and other persons present on the premises, within reasonable limits. If disorderly conduct is observed, the persons in question will be warned and, if necessary, may be asked to leave the premises.
1.5. First aid in case of accidents
In the event of an accident, the staff at Stäfeli will initiate immediate assistance measures to the extent reasonable. First aid supplies are available if needed. By law, every bather is obligated to provide first aid in the event of an accident until qualified emergency services arrive. Accidents must be reported to staff in all cases.
1.6. Assistance in averting reported dangers
If guests at the Stäfeli bathing facility credibly inform us of an imminent danger to the health and lives of other guests, the bathing facility, with the help of its staff, will make every reasonable effort to avert this danger.
1.7. No possibility of supervising minors, legally incapacitated persons, disabled persons and non-swimmers.
(1) The operators of the Stäfeli and therefore its staff are neither able nor obliged to supervise children, minors, persons with physical or mental disabilities and non-swimmers.
(2) Those who are normally responsible for the supervision of children, minors, non-swimmers, and people with disabilities (e.g., parents, guardians, relatives, or other supervisors, caregivers, or nurses) are responsible for ensuring their supervision. Increased supervision is required when using the attractions. This duty of supervision remains in effect even if the
The premises of the bath operator are not entered by the person responsible for supervision or are left prematurely.
(3) The applicable youth protection regulations, in particular alcohol and smoking bans, bans on being in certain places, obligations of parents/guardians, etc., must be observed by young people and their parents/guardians.
(4) Non-swimmers and children up to 10 years of age may only enter the bathing establishment accompanied by a supervising adult. From the age of 10, minors may only enter the bathing establishment with written permission from a parent or guardian.
1.8. Liability of Stäfeli
(1) We at Stäfeli are only liable for damages caused to bathers by us or our staff through unlawful, in particular breach of contract, and culpable conduct. The bathing facility assumes no liability for damages to third parties caused by items brought by guests.
(2) We at Stäfeli are not liable for damages caused by disregard of the bathing regulations, any other rules of use, or by failure to follow the instructions of the staff, by other fault on the part of the injured party, or by unavoidable events.
Damage caused by force majeure, including actions by third parties, is excluded. Contributory negligence will result in a corresponding apportionment of damages. The same applies analogously to any special rules of use posted at the respective equipment and facilities (e.g., for the waterfall or the counter-current system) as well as to any prohibitions or restrictions of use as defined in section 1.3, paragraph 2.
(3) The use of parking spaces is at your own risk. Stäfeli is neither obligated to guard parking spaces nor to maintain their surfaces and other facilities to protect vehicles from damage (e.g., from nails, broken glass, or potholes on the surfaces).
(4) Please do not leave valuables (mobile phone, wallet, etc.) unattended. We accept no liability for theft or loss.
2. Obligations of guests
2.1. Supervision of children, minors, non-swimmers and disabled persons
(1) Those who are otherwise responsible for the supervision of children, minors, non-swimmers, and disabled persons (e.g., legal guardians or appropriate supervisors or caregivers) must make adequate arrangements for the supervision of these persons. Minors up to the age of 10 must be accompanied by a responsible person.
(2) These persons responsible for supervision shall remain responsible for supervision even if they do not enter the premises of the bathing facility or leave prematurely.
(3) The applicable youth protection regulations, in particular those relating to alcohol and
Smoking bans, bans on being in certain areas, and obligations of parents/guardians must be observed by the young people and their parents/guardians.
2.2. Instructions from the staff at Stäfeli
(1) Guests are obliged to fully comply with the instructions of the responsible staff of the Stäfelis. This also applies if a bather should believe that the instruction given to him is unjustified.
(2) Anyone who violates the bathing regulations or prohibitions on the use of certain facilities
(e.g. waterfall, counter-current system, sauna) or restrictions as defined in point 1.3. para.2 or who disobeys the instructions of the responsible staff, may be expelled from the bathing facility by this or another representative of the bathing facility without entitlement to a refund of the entrance fee.
(3) In special cases, a future ban on visits may also be imposed. Failure to comply will make the guest liable to prosecution for trespassing.
2.5. Hygiene regulations
(1) Bathing guests are required to maintain the highest level of cleanliness throughout the entire bathing facility; a cleaning fee may be charged for deliberate soiling. Street shoes are not permitted in the barefoot area.
(2) The bathing facility must be used with normal, hygienically clean bathing clothing (e.g. swimsuit, bikini, swimming trunks, etc.).
(3) The bathing facility must not be visited by persons with contagious diseases.
(4) For hygienic reasons, showering is required before entering the pool. The showers must be turned off immediately after use.
(5) The use of soap, shampoos or detergents and the washing of swimwear in swimming pools and bathing pools is prohibited.
(6) Waste (bottles, cans, paper, etc.) must be disposed of in the designated waste containers.
2.6. Refraining from causing danger and nuisance
(1) Every bather is obliged to be considerate of other bathers, especially with regard to noise. Therefore, anything that disturbs or even endangers other bathers must be avoided.
(2) The boundaries of the bathing area must not be climbed or crossed.
(3) All facilities and equipment of the bath may only be used in accordance with their intended purpose (e.g. children's paddling pool, non-swimmer area, water slides).
(4) The customary rules of conduct in public establishments must be observed. Any sexual or intimate acts are prohibited and may result in a ban from the premises (without refund of any payment already made) and criminal charges.
(5) Photographing and filming people without their express consent is strictly prohibited.
2.8. Use of pools, equipment, etc.
(1) The equipment and facilities offered in the bath (e.g. waterfall) must be used in accordance with the rules of use.
(2) Users of the equipment and facilities must ensure that other bathers are not endangered. Bathers in the vicinity of equipment and facilities must ensure that users of the equipment and facilities do not endanger themselves or other bathers. Bathers must be considerate of one another; there is a special duty of supervision for minors.
(3) The instructions of the staff must be followed without fail.
2.9. Use of additional facilities
(1) Deck chairs, table tennis equipment and other facilities may be used while supplies last.
(2) Each bather may only occupy one seating or lounging area. If this area is not in use, long-term reservation by placing towels, bags, etc. on it is not permitted – if necessary, these items may be removed by the bathing staff.
(3) Compensation shall be provided for loss or damage.
2.10. Bringing in and loss of items, parking of vehicles
(1) Valuables should be left in the room if possible.
No liability is accepted for valuables.
(2) Found items must be handed in at the ticket office against confirmation.
(3) Vehicles or other objects may only be parked in such a way that access to the bath is not obstructed, especially with regard to rescue, fire brigade or police operations.
2.11. Reporting obligations / Duty to provide assistance
(1) Accidents, thefts and complaints must be reported immediately to the responsible staff or the management of the Stäfelis.
(2) Every bather is obliged to provide necessary first aid or other assistance.
2.12. Consumption of food, alcohol and beverages
(1) Food and drinks may only be consumed in the areas designated for this purpose.
(2) The use of glassware is prohibited in the barefoot area.
2.13. Other
(1) Any type of commercial activity or advertising in the area of the bathing facility requires the consent of the owner.
(2) Smoking is only permitted in outdoor areas.
